By accessing or using WhatSmartApp services, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before proceeding to use our services.
Customer Obligations
The customer undertakes to obtain in advance from the user to whom the message is to be sent consent in any form, such as oral, written, Email, etc.
The customer is obligated not to send any message that falls under the following items:
- Spam or bulk messages
- Messages that may cause malfunction of the Developer's equipment
- Messages via pornographic or other reprehensible content
- Messages that mislead users, such as those sent from someone else's name or giving false information
- Transmission of inaccurate, confidential information
- Transfer of information that has been unlawfully obtained by the Customer and/or violates the copyrights or related rights of third parties
- Advertising alcohol, tobacco and drugs, or other illegal means
- Transmission of information that violates the norms of the current legislation or international law
Communication with WhatsApp Inc. and Guarantees
- The Service and the WhatSmartApp Site are not supported or approved in any way by WhatsApp Inc. The Customer understands all risks associated with the use of the Service/Site/API.
- The developer is not responsible for the Customer's inability to get access to the service, to API, to accounts, etc. for reasons related to the disruption of the Internet channel, equipment or software of the Customer.
- The customer agrees that their account may be blocked and/or banned by WhatsApp and/or WhatsApp Inc.
- The developer is not responsible for the Customer's inability to access the service, to API due to software changes by WhatsApp Inc.
Website Usage
You are permitted to print and download extracts from the Website for Your own use on the following basis:
- No documents or related graphics on the Website are modified in any way
- No graphics on the Website are used separately from accompanying text
- Our copyright and trademark notices and this permission notice appear in all copies
REFUNDS / Cancel the Subscription
You can open a trial account for free days. Therefore, paid Subscription fees are non-refundable.
You can cancel the subscription anytime, and the instance will remain active until the end of the subscription term. Cancellation of the subscription must be before the start date of the next bill.
Premium Plans
WhatSmartApp offers different subscription plans with varying features and prices. Premium services may include:
- Unlimited message sending capabilities
- Unlimited media sharing
- Priority connection service
- Priority technical support
- Additional API features
API Usage Limitations
- Free instances have a quota of messages
- Exceeding the quota requires upgrading to a premium plan
- Multiple instances may require premium subscriptions
- API access is controlled by unique API keys for each instance
- Misuse of the API may result in service suspension
Data and Privacy
- WhatSmartApp stores only the data necessary to provide the service
- Message content is not stored on our servers
- The customer is responsible for ensuring their use of the service complies with applicable data protection laws
- WhatSmartApp may collect usage metrics to improve the service
Intellectual Property
All intellectual property rights in and to the Website and the Service are owned by WhatSmartApp. Any unauthorized use of the Website or its contents may violate copyright, trademark, and other laws.
Service Availability
- WhatSmartApp strives to provide uninterrupted service but does not guarantee 100% availability
- The service may be occasionally unavailable due to maintenance or updates
- The developer reserves the right to modify or discontinue the service with reasonable notice
Miscellaneous
- If any part of these terms of use are unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms of use will not be affected
- These terms of use set out the whole of Our agreement relating to use of and access to the Website. They may not be varied by You at any time. Nothing said by any person on Our behalf should be understood as a variation of these terms of use or an authorized representation about the Website or the nature and quality of items displayed thereon. We shall have no liability for any such representation being untrue or misleading.
- WhatSmartApp reserves the right to amend these Terms of Service at any time by posting the amended terms on the Website.
